Mediation is a fast and direct way to resolve disputes. Whether there are two or more parties the conflict is resolved through dialogue and the goal is to reach a settlement which satisfies all parties involved.

What happens in mediation?

Mediation is an effective way of resolving disputes with full confidentiality and out of court or arbitration.

A neutral and impartial mediator helps the parties to identify the conflict issues, discuss individual interests and needs and finally helps the parties to find solutions that suit the parties’ situation and comply with the their interests and needs.

The goal is to reach a mutually satisfactory settlement based on the parties’ interests and needs rather than legal standards only. Mediation does not only focus on the legal issues. You get the chance to speak up and decide the best way to resolve the conflict yourself instead of letting a judge make the decision.

In most construction projects it is necessary for the parties to continue to cooperate. Unlike civil litigation or arbitration, mediation offers the possibility to take the parties’ professional relation into consideration.

International companies increasingly choose to use mediation.

Mediation gives the parties the chance to move on as soon as possible in the best possible way.

How long does a mediation take?

Depending on the complexity of the case a construction related conflict typically gets settled over one to two sessions. The Mediation Institute also offers a fast track process that ensures that the mediation will take place within 48 hours and will be completed within 7 days.

Is mediation the right process for my case?

Mediation can be used in almost all building project disputes and is an integrated part of AB18.

What does mediation cost?

In disputes where both parties are professionals the price for mediation is DKK 30.000 plus VAT. The price covers a full day of mediation (up to 8 hours) and the mediator’s ordinary preparation. If one of the parties is a consumer see here.

If there is a need for more hours to prepare and/or finalize the mediation these complementary hours are billed at DKK 2.500 + VAT pr. hour.

Fast Track Mediation

If you choose fast track mediation, we will do everything in our power to make sure that mediation is completed within 7 days after your request. In case of fast track mediation, a supplementary fee equaling to 5o % of the normal price will be charged.



Examples

3 1/2 års retssag afsluttet efter 3 timers mægling UK

UK En håndværker afgav tilbud på at indrette et uudnyttet loftsrum til to værelser ved opsætning af vægge, isolering og isætning af vinduer. Ejeren af huset skulle selv udføre en del af arbejdet i forbindelse med færdiggørelsen af indretningen.

Efter at arbejdet var gået igang, blev det konstateret, at gulvene i loftsrummet gyngede, og at der skulle udlægges forstærkning af gulvet, for at rummene kunne anvendes til beboelse…


Strid mellem bygherre og rådgiver løst gennem mediation UK

UK Under den fortsatte ombygning fandt bygherren ud af, at de anvisninger, den første rådgiver var kommet med, ikke kunne godkendes af myndighederne. Bygherren mente, at dette havde påført ham ekstra omkostninger.

Efter et par timers mediation fik parterne klarlagt deres gensidige forventninger i forbindelse med den første del af ombygningen, og parterne fandt herefter frem til en fælles løsning…


Fra 0 kr. til 50.000 kr. på to møder UK

UK En arkitekt sagsøger bygherre for ca. 50.000 kr. for udarbejdelse af tegninger. Bygherren vil ikke betale.

Tegningerne er i orden, men byggeriet kan ikke opføres indenfor den økonomiske ramme, som bygherre har fastsat.

Begge parter er repræsenteret ved advokat, men parterne vælger at møde alene til retsmæglingen…
